Why is mediation important for resolving disputes?

Mediation offers a cost-effective, quicker, and less stressful alternative to going to court. By working with a neutral mediator, parties can come to a mutually acceptable resolution, which can preserve relationships and lead to more sustainable outcomes. It empowers all parties to take control of the process rather than leaving the decision in the hands of a judge.

How does mediation save time and money compared to going to court?

Court cases can take months or even years, leading to escalating costs in legal fees and the potential for drawn-out stress. Mediation, on the other hand, is typically completed much faster, and the fees are significantly lower. It allows you to resolve the issue without the need for costly litigation.

What happens if one party doesn't want to mediate?

If one party is unwilling to mediate, I can still offer consultancy services. I’ll assess the situation, provide expert advice, and help guide the process toward a resolution. This ensures that even if mediation isn't fully possible, progress can still be made through constructive dialogue.

Is mediation legally binding?

Mediation itself is not legally binding, but once an agreement is reached, it can be made legally binding through a formal contract. This means that the resolution reached in mediation has the same legal standing as a court judgment once both parties sign the agreement.

Why have courts begun encouraging mediation more strongly?

In recent years, courts have increasingly recognised the value of mediation. In fact, the October 2024 court directives strongly encourage parties to mediate before pursuing litigation. This move aims to reduce court congestion, save costs, and provide a more amicable and effective resolution to disputes.

What are the advantages of mediation over litigation?

Mediation allows for more flexibility, confidentiality, and creative solutions that may not be available in a court setting. The process is often less formal, giving participants more control over the outcome, and it typically leads to better long-term solutions. Mediation also helps to preserve relationships, making it ideal for ongoing business or personal relationships.
